What New Mexico Sellers Say About Selling An Estate Property

These reviews load live from our Google Business Profile.

Executor of an estate? Can I sell the house while probate is still open?

Usually, yes. Going under contract and closing are two separate events, and only the second one waits on the estate. We can put a price in writing now. Whether your estate is far enough along to close is a question for your attorney and the title company, not for us.

Under contract does not mean sold. The purchase agreement fixes the price, the condition terms, and who pays for what. Nothing transfers until the title company is satisfied it can insure the sale. That gap is ordinary, and it is where most estate transactions sit for a while.

We are the buyer, not the estate’s lawyer. Nothing here is legal advice and we do not represent the estate. If the estate side is unsettled, your attorney is the person to ask, and we are glad to point you toward New Mexico people who do that work. Past that point, our only job is buying the house.

Do I need court approval before I can accept an offer?

Ask the estate’s attorney. What a given estate requires depends on documents we do not have and are not qualified to read, and guessing at it would not help you. What we can tell you is what happens on our side while you find out.

The number does not move while you find out. We make the offer after reviewing the condition, not before, and once it is in writing we do not revisit it. No inspection renegotiation, no repair credits, no punch list at the end.

Closing waits on the title company, not on us. We open title with a New Mexico title company and their examiner decides what is required to insure the sale. We do not stack requirements of our own on top of theirs, and we do not prepare estate paperwork.

What does the title company need from me?

They will tell you directly, and the list is specific to your estate. We open title early precisely so that list arrives early instead of surfacing the week you hoped to close. Their examiner is the one who decides what satisfies them.

We are not the gatekeeper here. Our contract does not layer extra conditions on top of what the title company asks for. If something they want is missing, that is a conversation between you, your attorney, and them.

You do not need any of it before you call us. People reach out with an address and a rough sense of where things stand. That is enough for us to look at the property and start a conversation.

What if the estate has debts or liens against the property?

Recorded liens and back taxes generally come off the top at closing, paid out of the sale proceeds through the title company. You do not clear them in advance and you do not pay them out of pocket. The title company pulls what is recorded against the property and handles the payoffs at the closing table.

A lien is not a reason we walk away. We buy properties carrying recorded liens, back taxes, and open code violations. What is recorded changes what the estate nets, not whether we are willing to buy. The settlement statement shows every payoff line by line.

Debts of the estate generally are a different subject. We can speak to what is recorded against the property, because that is what shows up in a title search. Anything broader belongs with the attorney handling the estate.

Personal representative? What if you live out of state?

You do not need to fly in. We cover a mobile or remote notary at our expense so you can sign wherever you are, and your proceeds go out by wire or by check, whichever you prefer. A good share of the estate properties we buy are handled entirely from another state.

The condition review does not need you either. Send photos, or if you would rather someone see it in person, we will do a walkthrough with whoever has access. Either way we look at the property before the number goes out, not after.

Nobody has to empty the house first. No repairs, no cleaning, no hauling anything off, and no cleanout fee. Furniture, a garage full of tools, boxes stored for decades: leave all of it. What is inside becomes our problem after closing.

Selling during probate? How do I show the heirs this was handled right?

With paper. The offer comes to you in writing, the price in the contract is the price we close at, and a New Mexico title company runs the closing and issues a settlement statement accounting for every dollar. That is a document you can hand to anyone who asks how the number was reached.

We do not renegotiate after seeing the condition. The order matters. We review the property first, then make the offer. There is no second look that shaves the price, no repair credit, and no list of deductions at the end. What you agreed to is what funds.

The money does not move through us. Funds go through the title company, which disburses according to the settlement statement. If beneficiaries want to see where proceeds went, the paperwork is already built to show them.

How to Get a Cash Offer on an Estate Property

Five step process to sell a New Mexico house in probate, from telling us about the estate to signing anywhere and getting paid

1. Tell us about the estate. The address, the condition, and roughly where things stand.

2. Photos or walkthrough. Send pictures, or we come out and look if you would rather someone see it in person.

3. Offer in writing. No obligation and no fee for asking. The number comes after we review the condition, not before.

4. You set the timeline. We open title with a New Mexico title company, and closing happens when the estate is ready.

5. Sign anywhere and get paid. A mobile or remote notary at our expense means you can sign from wherever you are, and proceeds go out by wire or by check.
